What CCP § 335.1 actually covers

Code of Civil Procedure § 335.1 provides a two-year period for an action for assault, battery, or injury to or death of an individual caused by another’s wrongful act or neglect. Other statutes govern claims such as medical malpractice and claims against public entities.

California uses proportional fault

The California Supreme Court adopted pure comparative negligence in Li v. Yellow Cab. In an ordinary negligence action, a claimant’s negligence can reduce recovery in proportion to fault rather than automatically barring it at a fixed percentage. Later law can affect allocation among defendants and particular claim types.

Public-entity claims need a separate calendar

A damages claim involving a California public entity can require an administrative claim before a lawsuit. The Government Claims Program directs users to the governing claim process, but the responsible entity and deadline must be identified from the facts.
