Start with Civil Practice and Remedies Code § 16.003

Section 16.003 generally says a suit for personal injury must be brought no later than two years after the cause of action accrues. The chapter also contains exceptions and specialized provisions. Claims involving a public body, a different cause of action, or a disputed accrual date require separate analysis.

Read the 51% bar carefully

Chapter 33 says a claimant may not recover damages when the claimant’s percentage of responsibility is greater than 50%. A percentage at or below that point can still reduce the award. The chapter’s scope and definitions matter, so the short label is not a substitute for the full text.

Questions to take to a Texas lawyer

Ask which cause of action applies, when it accrued, whether a notice rule or exception changes the calendar, and whether Chapter 33 governs the particular claim. Bring the incident date, reports, correspondence, and a list of every potentially responsible party.
