Before the directory

Illinois has a separate clock for many local-government injuries

An Illinois injury involving a private driver or store does not begin with the same procedural map as one involving a city park, public school, transit property, or municipal employee. The general two-year personal-injury provision may be displaced by a shorter statute for claims against local entities, and the Tort Immunity Act can affect the underlying duty or defense.

Location matters beyond Chicago. Dense transit and pedestrian evidence in Cook County differs from interstate, agricultural, industrial, or campus evidence elsewhere in the state. Use the firms below to find lawyers to compare, then ask each one to identify the defendant, forum, limitation provision, and evidence plan.

Chicago and Cook County

CTA, Metra, city streets, park districts, schools, airports, private premises, and delivery traffic can put multiple entities in the same factual scene. Keep the exact route, stop, address, report number, and operator identity.

General timing starting pointTwo years for the personal-injury category in 735 ILCS 5/13-202
Fault-rule starting pointRecovery barred when claimant fault is more than 50%

Illinois puts its personal-injury limitations provision in Article XIII of the Code of Civil Procedure and its modified comparative-fault rule in § 2-1116. Each section contains scope language that matters more than the shorthand label.

Begin with the action, not just the incident date

735 ILCS 5/13-202 generally says actions for damages for an injury to the person must be commenced within two years after accrual, while also listing exceptions and additional language. Government defendants, medical claims, and other causes of action require separate research.

Illinois uses a more-than-50% bar

Under 735 ILCS 5/2-1116, a plaintiff in a covered action is barred when contributory fault is more than 50% of the proximate cause. When fault is not more than 50%, allowed damages are diminished in proportion to the plaintiff’s fault.

Verify the lawyer and the forum separately

The Illinois ARDC lawyer search is the licensing source. Court location, venue, and filing requirements are separate questions; a firm’s address alone does not establish where a lawsuit should be filed.

Regional differences

How the investigation can change across Illinois

Collar counties and regional travel

I-90, I-88, I-55, I-80, suburban arterials, commuter rail, and logistics facilities may involve several counties and commercial actors. Preserve electronic vehicle, dispatch, and employment information early.

Central and downstate settings

University towns, state facilities, local parks, farms, factories, and long-distance medical travel present different control and record questions. Do not assume a familiar public name identifies the legal defendant.

Animal injuries

Dog bites need their own evidence file

Section 16 of the Illinois Animal Control Act addresses an owner’s civil liability when a dog or other animal, without provocation, attacks, attempts to attack, or injures a person who is peaceably conducting themselves where lawfully present. The statutory elements make scene, provocation, lawful-presence, owner, and medical evidence important.

Government and schools

Public ownership can change the procedure

745 ILCS 10/8-101 generally requires many civil actions against a local entity or employee to be commenced within one year, with a different provision for patient-care claims. Other Tort Immunity Act sections can govern duties and immunities for public property, recreation, and supervision. State claims can follow a separate Court of Claims process.

Questions for a first call

Illinois injury claim FAQs

6 answers
Is two years always the Illinois deadline?+

No. Section 13-202 is a general personal-injury provision with exceptions. Different claims, parties, accrual rules, and tolling provisions can produce a different result.

What happens at exactly 50% plaintiff fault?+

Section 2-1116 bars recovery when plaintiff fault is more than 50%. At 50% or less, allowed damages are reduced proportionately, subject to the section’s scope.

Does a Chicago firm profile prove the firm can handle my county?+

No. Confirm service area, venue, licensing, and the particular matter directly with the firm.

Why can an Illinois city or school claim have a shorter period?+

The Local Governmental and Governmental Employees Tort Immunity Act contains a one-year provision for many covered injuries, subject to scope and exceptions.

Does the Animal Control Act cover more than bites?+

Its text refers to an animal that attacks, attempts to attack, or injures, provided the other statutory elements are met.

What should I ask about a Chicago transit or park incident?+

Ask which entity controlled the exact place or vehicle, what immunity provisions may apply, which reports or footage exist, and which filing period governs.
