Florida files often begin with overlapping insurance and liability questions

In Florida, the first paperwork after an injury can send a reader in several directions at once: PIP documents, a liability claim, a premises report, an animal-control record, or notice to a public body. Do not let the first insurer or form define the entire case. Identify the incident type, all possible policies, the responsible people and entities, and the legal basis for each potential claim.

South Florida adds dense roads, airports, cruise and visitor movement, waterfront public spaces, and multiple municipal and county systems. A Jacksonville or Panhandle file can present a very different geographic and provider network. The firms below give readers options to compare, while the editorial material keeps the comparison tied to evidence, deadlines, and the correct defendant.

South Florida travel and visitors

Miami and Fort Lauderdale combine I-95, local arterials, airports, transit, hotels, rideshare zones, beaches, and pedestrian destinations. Preserve tickets, app records, photographs, precise pickup points, and the identity of each operator; “the airport” or “downtown” is usually not specific enough.

State law, in context

Rules to put on the first consultation agenda

Open the source notes →
General timing starting pointTwo years for an action founded on negligence
Fault-rule starting pointRecovery barred when a party is more than 50% at fault

Florida changed important negligence rules in 2023. The current statutory text is therefore more useful than an undated summary: § 95.11 supplies the limitations categories and § 768.81 states the comparative-fault rule and its exceptions.

Separate negligence from other causes of action

Florida Statutes § 95.11 currently places an action founded on negligence in a two-year category. Intentional torts, product-related injuries, medical malpractice, wrongful death, and other claims appear in separate provisions. The correct label matters before any date is calculated.

The current greater-than-50% rule

Section 768.81 says contributory fault generally reduces damages proportionately and that a party found more than 50% at fault for that party’s own harm may not recover. The statute states an exception for medical-negligence actions and contains rules about applicability and allocation.

Auto claims add a coverage layer

Florida’s Department of Financial Services explains required PIP and property-damage coverage and optional coverages. Coverage questions and tort questions are related but not interchangeable; policy terms and the no-fault statutes can affect the path of an auto-injury claim.

Regional differences

How the investigation can change across Florida

Central and northern corridors

Orlando tourism traffic, Tampa Bay crossings, and Jacksonville’s large road network can involve visitors, rental vehicles, commercial fleets, and several insurance policies. A lawyer should explain how coverage investigation and negligence analysis fit together.

Public spaces and schools

A city park, county facility, public school, state university, charter operator, and private campus may trigger different procedures. Keep reports, witness contacts, enrollment or event documents, and communications that identify who controlled the place or activity.

Animal injuries

Dog bites need their own evidence file

Florida Statutes § 767.04 makes a dog owner liable for specified bite damages when the person is in a public place or lawfully in a private place, regardless of former viciousness or the owner’s knowledge. The statute also addresses comparative negligence and a posted-sign exception with its own qualifications. Preserve the scene, sign, owner, witness, medical, and animal-control evidence.

Government and schools

Public ownership can change the procedure

Section 768.28 governs tort claims against Florida and its agencies or subdivisions and contains notice, waiting-period, immunity, damages, and timing provisions. Municipal claims are treated differently in parts of the statute. A park, public school, transit, road, or airport incident should begin with exact entity identification—not the assumption that every public-looking location has the same owner.

Questions that reveal how a firm would handle the work

ExperienceAsk for experience with the incident, defendant, insurance, and procedural issues—not only “personal injury” generally.

PeopleWho is the responsible lawyer? Who gathers records, returns calls, negotiates, and recommends suit?

EvidenceWhich records need immediate preservation, who will request them, and might an expert or site inspection be needed?

MoneyAsk how the fee is calculated, which costs are advanced, how liens are handled, and what is owed if the matter is unsuccessful.

Questions for a first call

Florida injury claim FAQs

6 answers
Is every Florida personal-injury action limited to two years?+

No. The current statute divides claims into categories. The claim’s legal basis, accrual date, and applicable exceptions determine which provision controls.

Can someone who is exactly 50% at fault recover under § 768.81?+

The current text bars a party found greater than 50% at fault. Damages can still be reduced by the assigned percentage, and exceptions or other rules may apply.

Is PIP the same as liability coverage?+

No. PIP, property-damage liability, bodily-injury liability, and UM/UIM coverage serve different functions. Review the policy and current Florida guidance.

Does opening a Florida PIP claim protect every deadline?+

No. Insurance benefits and court filing periods are different systems. Ask which causes of action and notice procedures apply.

What evidence matters after a Florida dog bite?+

Photograph injuries, the location, gates, and any warning sign; keep owner and witness details, medical records, animal-control information, and clothing.

Are airport and school injuries automatically government claims?+

No. Airports and schools can involve public bodies, private contractors, vendors, or several entities. Control and legal status must be investigated.
